1. Acceptance of Terms

By downloading, installing, or using the Shiftrio mobile application (formerly Shifter) ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Emirhan Şahin ("we", "our", "us"), the developer and operator of Shiftrio.

These Terms apply to all users of Shiftrio on iOS and Android, regardless of the country in which you reside. Users in Turkey are additionally subject to applicable Turkish consumer law.

2. Description of Service

Shiftrio is a shift scheduling and team management application designed for restaurants and similar hospitality businesses. The App enables:

  • Creating and publishing weekly shift schedules
  • Managing leave requests and shift swap requests
  • Organizing teams across multiple branches and departments
  • Declaring employee availability
  • Receiving push notifications for schedule updates and request decisions

We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where possible.

3. User Accounts and Roles

3.1 Account Registration

To use Shiftrio you must create an account using a valid email address or a supported third-party authentication provider (e.g., Google Sign-In). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 Roles

Shiftrio operates on a two-role model within each restaurant branch:

  • Manager (Admin): Can create and manage branches, invite employees, publish shift schedules, manage departments, and approve or reject leave and swap requests. The restaurant owner holds the primary admin role.
  • Employee: Can view their assigned shifts, submit leave and swap requests, declare availability, and receive notifications. Employees cannot modify schedules or manage other users.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and to keep your information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscriptions and Billing

4.1 Subscription Plans

Shiftrio offers a free tier and paid subscription plans ("Starter", "Growth", "Enterprise") that raise the employee limit. Every plan includes every feature; plans differ only in the number of employees. Subscriptions are purchased and managed through the Apple App Store (iOS) or Google Play Store (Android).

4.2 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the end of the current period. Your payment account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Pricing

Subscription prices are displayed in the App before purchase and may vary by region due to local taxes and App Store pricing tiers. Prices are subject to change; we will notify you of price changes before they take effect.

4.4 Free Trial

Where offered, free trial periods are available for new subscribers only. If you do not cancel before the trial ends, you will be charged the applicable subscription price.

4.5 Payment Processing

All payments are processed by Apple Inc. or Google LLC through their respective app store platforms. We do not directly process or store your payment card details. Subscription management is handled by RevenueCat, Inc. on our behalf.

5. Cancellation Policy

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date.

  • iOS: Go to Settings → [your Apple ID] → Subscriptions → Shiftrio → Cancel.
  • Android: Open Google Play → tap your profile icon → Payments & subscriptions → Subscriptions → Shiftrio → Cancel.

We do not offer refunds for partially used billing periods, except where required by applicable law or at our sole discretion.

6. Prohibited Uses

You agree not to use Shiftrio to:

  • Violate any applicable local, national, or international law or regulation
  • Transmit any content that is unlawful, harmful, threatening, abusive, or defamatory
  • Impersonate any person or entity, or falsely state your affiliation with any person or entity
  • Attempt to gain unauthorized access to any part of the App or its related systems
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Use the App to send unsolicited communications (spam)
  • Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure
  • Use automated scripts, bots, or scrapers to access or collect data from the App
  • Resell, sublicense, or otherwise commercialize access to the App without our express written consent

Violation of these prohibitions may result in immediate termination of your account without notice.

7. Intellectual Property

The App, including its design, code, graphics, user interface, trademarks, and all content created by us, is the exclusive intellectual property of Emirhan Şahin (Shiftrio) and is protected by applicable copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal or internal business purposes, strictly in accordance with these Terms. This licence does not include any right to reproduce, modify, distribute, or create derivative works from the App.

Content you create within the App (shift schedules, team data, etc.) remains your property. You grant us a limited licence to process and store that content solely to provide the service to you.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content accessible through the App.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you in full.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMİRHAN ŞAHİN (SHIFTRIO) AND ANY EMPLOYEES OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

10. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or in connection with the App shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.

Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey. If you are a consumer in a jurisdiction that grants you the right to bring proceedings in your local courts, that right is not affected by this clause.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our service, applicable law, or for other legitimate reasons. When we make material changes, we will notify you through the App or by email at least 7 days before the new Terms take effect.

Your continued use of Shiftrio after the effective date of the updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the App and cancel any active subscription.

1. Koşulların Kabulü

Shiftrio (eski adıyla Shifter) mobil uygulamasını ("Uygulama") indirerek, yükleyerek veya kullanarak bu Kullanım Koşullarını ("Koşullar") kabul etmiş olursunuz. Bu Koşulları kabul etmiyorsanız Uygulamayı kullanmayınız.

Bu Koşullar, siz ile Shiftrio'nun geliştiricisi ve işleticisi olan Emirhan Şahin ("biz", "bizim") arasında hukuki açıdan bağlayıcı bir sözleşme oluşturmaktadır.

Bu Koşullar, ikamet ettiğiniz ülkten bağımsız olarak iOS ve Android'de Shiftrio kullanan tüm kullanıcılara uygulanır. Türkiye'deki kullanıcılar, ayrıca ilgili Türk tüketici mevzuatına da tabidir.

2. Hizmetin Tanımı

Shiftrio; restoranlar ve benzer konaklama/yiyecek-içecek işletmeleri için tasarlanmış bir vardiya planlama ve ekip yönetimi uygulamasıdır. Uygulama aşağıdaki işlevleri sunar:

  • Haftalık vardiya programlarının oluşturulması ve yayımlanması
  • İzin talepleri ve vardiya değişim taleplerinin yönetimi
  • Birden fazla şube ve departman genelinde ekip organizasyonu
  • Çalışan müsaitliğinin beyanı
  • Program güncellemeleri ve talep kararları için anlık bildirim alınması

Uygulamanın herhangi bir bölümünü, makul ölçüde önceden bildirimde bulunarak, istediğimiz zaman değiştirme, askıya alma veya durdurma hakkını saklı tutarız.

3. Kullanıcı Hesapları ve Roller

3.1 Hesap Oluşturma

Shiftrio'yu kullanabilmek için geçerli bir e-posta adresi veya desteklenen üçüncü taraf bir kimlik doğrulama sağlayıcısı (örn. Google ile Giriş) aracılığıyla bir hesap oluşturmanız gerekmektedir. Hesap kimlik bilgilerinizin gizliliğini korumak ve hesabınız altında gerçekleşen tüm etkinliklerden siz sorumlusunuz.

3.2 Roller

Shiftrio, her restoran şubesinde iki rollü bir model üzerinde çalışmaktadır:

  • Yönetici (Admin): Şube oluşturabilir ve yönetebilir, çalışan davet edebilir, vardiya programı yayımlayabilir, departmanları yönetebilir, izin ve takas taleplerini onaylayıp reddedebilir. Restoran sahibi birincil yönetici rolünü üstlenir.
  • Çalışan: Atanan vardiyaları görüntüleyebilir, izin ve takas taleplerini gönderebilir, müsaitliğini beyan edebilir ve bildirim alabilir. Çalışanlar, programları değiştiremez veya diğer kullanıcıları yönetemez.

3.3 Hesap Doğruluğu

Hesap oluştururken doğru, güncel ve eksiksiz bilgi vermeyi ve bilgilerinizi güncel tutmayı kabul edersiniz. Yanlış veya yanıltıcı bilgi içeren hesapları askıya alma veya sonlandırma hakkını saklı tutarız.

4. Abonelikler ve Faturalandırma

4.1 Abonelik Planları

Shiftrio; ücretsiz bir katman ile daha yüksek çalışan limiti sunan ücretli abonelik planları ("Starter", "Growth", "Enterprise") sunmaktadır. Tüm özellikler her planda yer alır; planlar yalnızca çalışan limitine göre değişir. Abonelikler, Apple App Store (iOS) veya Google Play Store (Android) üzerinden satın alınır ve yönetilir.

4.2 Otomatik Yenileme

Ücretli abonelikler, mevcut dönemin bitiminden en az 24 saat önce iptal edilmediği takdirde her faturalandırma dönemi sonunda (aylık veya yıllık) otomatik olarak yenilenir. Ödeme hesabınız, mevcut dönemin bitiminden 24 saat öncesine kadar yenileme için ücretlendirilir.

4.3 Fiyatlandırma

Abonelik fiyatları, satın alma öncesinde Uygulama içinde gösterilir ve yerel vergiler ile App Store fiyatlandırma kademelerine bağlı olarak bölgeye göre farklılık gösterebilir. Fiyatlar değiştirilebilir; değişikliklerden önce sizi bilgilendireceğiz.

4.4 Ücretsiz Deneme

Sunulduğu durumlarda ücretsiz deneme süreleri yalnızca yeni aboneler için geçerlidir. Deneme süresi dolmadan iptal etmezseniz, geçerli abonelik ücreti tahsil edilir.

4.5 Ödeme İşleme

Tüm ödemeler, ilgili uygulama mağazası platformları aracılığıyla Apple Inc. veya Google LLC tarafından işlenir. Ödeme kartı bilgilerinizi doğrudan işlemez veya saklamayız. Abonelik yönetimi, bizim adımıza RevenueCat, Inc. tarafından yürütülmektedir.

5. İptal Politikası

Aboneliğinizi istediğiniz zaman App Store veya Google Play hesap ayarlarınızdan iptal edebilirsiniz. İptal işlemi mevcut faturalandırma döneminin sonunda geçerli olur — o tarihe kadar ücretli özelliklere erişiminiz devam eder.

  • iOS: Ayarlar → [Apple Kimliğiniz] → Abonelikler → Shiftrio → İptal Et.
  • Android: Google Play'i açın → profil simgenize dokunun → Ödemeler ve abonelikler → Abonelikler → Shiftrio → İptal Et.

Kısmen kullanılmış faturalandırma dönemleri için, ilgili mevzuatın zorunlu kıldığı durumlar veya kendi takdirimize bağlı haller dışında iade yapılmamaktadır.

6. Yasaklanan Kullanımlar

Shiftrio'yu aşağıdaki amaçlarla kullanmamayı kabul edersiniz:

  • Yürürlükteki yerel, ulusal veya uluslararası herhangi bir kanun veya yönetmeliği ihlal etmek
  • Yasadışı, zararlı, tehdit edici, taciz edici veya iftira niteliğinde içerik iletmek
  • Herhangi bir kişi veya kuruluşu taklit etmek ya da bir kişi veya kuruluşla bağlantınız olduğunu yanlış beyan etmek
  • Uygulamanın veya ilgili sistemlerin herhangi bir bölümüne yetkisiz erişim sağlamaya çalışmak
  • Uygulamanın kaynak kodunu tersine mühendislik, derleme veya başka yöntemlerle elde etmeye çalışmak
  • İstenmeyen iletişim (spam) göndermek için Uygulamayı kullanmak
  • Uygulamanın bütünlüğünü veya performansını ya da temel altyapısını aksatmak veya bozmak
  • Uygulamaya erişmek veya veri toplamak için otomatik komut dosyaları, botlar veya tarayıcılar kullanmak
  • Yazılı açık iznimiz olmaksızın Uygulamaya erişimi yeniden satmak, alt lisanslamak veya ticari amaçla kullanmak

Bu yasakların ihlali, önceden bildirimde bulunmaksızın hesabınızın derhal sonlandırılmasıyla sonuçlanabilir.

7. Fikri Mülkiyet

Uygulama; tasarımı, kodu, grafikleri, kullanıcı arayüzü, ticari markaları ve tarafımızca oluşturulan tüm içerik dahil olmak üzere Emirhan Şahin'in (Shiftrio) münhasır fikri mülkiyetidir ve geçerli telif hakkı, ticari marka ve diğer fikri mülkiyet mevzuatı tarafından korunmaktadır.

Size, Uygulamayı yalnızca kişisel veya dahili iş amaçlarınız için ve bu Koşullara kesinlikle uygun şekilde kullanmanız amacıyla sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans tanıyoruz. Bu lisans; Uygulamayı çoğaltma, değiştirme, dağıtma veya türev eserler oluşturma hakkını içermemektedir.

Uygulama içinde oluşturduğunuz içerikler (vardiya programları, ekip verileri vb.) size aittir. Bize, söz konusu içeriği yalnızca size hizmeti sunmak amacıyla işlemek ve depolamak için sınırlı bir lisans verirsiniz.

8. Garanti Reddi

UYGULAMA, TİCARİ ELVERİŞLİLİK, BELİRLİ BİR AMACA UYGUNLUK VE İHLAL ETMEME GARANTİLERİ DAHİL ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE HERHANGİ BİR AÇIK VEYA ZIMNİ GARANTİ VERİLMEKSİZİN "OLDUĞU GİBİ" VE "MEVCUT HÂLDE" SUNULMAKTADIR.

Uygulamanın kesintisiz, hatasız veya virüs ya da diğer zararlı bileşenlerden arındırılmış olacağını garanti etmiyoruz. Uygulama aracılığıyla erişilebilen herhangi bir içeriğin doğruluğunu, eksiksizliğini veya güvenilirliğini garanti etmiyoruz.

Bazı yargı bölgeleri zımni garantilerin hariç tutulmasına izin vermemektedir; bu nedenle yukarıdaki hariç tutma sizin için tam olarak geçerli olmayabilir.

9. Sorumluluğun Sınırlandırılması

YÜRÜRLÜKTE OLAN MEVZUATIN İZİN VERDİĞİ AZAMI ÖLÇÜDE, EMİRHAN ŞAHİN (SHIFTRIO) VE VARSA ÇALIŞANLARI VE TEMSİLCİLERİ; UYGULAMANIN KULLANIMINDAN VEYA KULLANILAMAZ OLMASINDAN KAYNAKLANAN YA DA BUNLARLA İLGİLİ DOLAYLI, ARIZÎ, ÖZEL, SONUÇ OLARAK ORTAYA ÇIKAN VEYA CEZAİ ZARARLARDAN, BU TÜR ZARARLARIN OLASILIĞINA DAİR UYARILMIŞ OLSAK DAHİ, SORUMLU TUTULAMAZ.

HERHANGİ BİR TALEPTEN KAYNAKLANAN VEYA BU KOŞULLAR YA DA UYGULAMAYLA İLGİLİ OLAN TOPLAM SORUMLULUĞUMUZ, TALEPTEKİ ON İKİ (12) AY ÖNCESİNDE BİZE ÖDEDİĞİNİZ MİKTARI AŞMAYACAKTIR.

Bu Koşullardaki hiçbir hüküm, ihmalimizden kaynaklanan ölüm veya kişisel yaralanma, dolandırıcılık veya hileli beyan ya da kanun tarafından hariç tutulamayan diğer herhangi bir sorumluluk için sorumluluğumuzu sınırlandırmaz.

10. Geçerli Hukuk ve Uyuşmazlık Çözümü

Bu Koşullar ve Uygulamayla bağlantılı olarak ortaya çıkan her türlü uyuşmazlık, kanunlar ihtilafı ilkeleri gözetilmeksizin Türkiye Cumhuriyeti hukukuna göre yorumlanır ve bu hukuka tabidir.

Dostane yollarla çözümlenemeyen her türlü uyuşmazlık, İstanbul mahkemelerinin münhasır yargı yetkisine sunulacaktır. Yerel mahkemelerinizde dava açma hakkı tanıyan bir yargı bölgesinde tüketici konumundaysanız bu hakkınız bu hüküm tarafından etkilenmez.

11. Koşullardaki Değişiklikler

Bu Koşulları; hizmetimizde yapılan değişiklikleri, yürürlükteki mevzuatı veya diğer meşru gerekçeleri yansıtmak amacıyla zaman zaman güncelleyebiliriz. Önemli değişiklikler yaptığımızda, yeni Koşullar yürürlüğe girmeden en az 7 gün önce sizi uygulama üzerinden veya e-posta yoluyla bilgilendireceğiz.

Güncellenmiş Koşulların yürürlük tarihinden sonra Shiftrio'yu kullanmaya devam etmeniz, söz konusu değişiklikleri kabul ettiğiniz anlamına gelir. Güncellenmiş Koşulları kabul etmiyorsanız Uygulamayı kullanmayı bırakmanız ve varsa aktif aboneliğinizi iptal etmeniz gerekmektedir.
